1. Introduction

1.1 Definitions

"Terms" refers to these terms of use as set out in this document.

"PLUS member" / "PLUS membership" refers to a registered paying member whose balance is greater than zero points. The member is responsible for continually topping up points via the available payment methods to keep access to PLUS benefits.

"Standard member" / "Standard membership" refers to a registered member whose balance is zero points.

"The Service" refers to the Xiqora website and its associated services.

"XQ" refers to Xiqora and the registered trademark Xiqora®.

1.2 Validity and scope of the Terms

These Terms were last updated on 2 August 2017 and remain in force until further notice.

The Terms apply to all content, all use and all services offered under the main domain xiqora.com and the other domains used to market Xiqora.

If any provision of the Terms is found invalid, this does not render the Terms as a whole invalid. In such cases, to the extent the invalidity materially affects either party's performance, the Terms shall be reasonably adjusted.

1.3 Acceptance of the Terms

To use the Service you must accept this agreement in full as described in this document. If you do not accept these Terms you have no right to register on or continue using the Service.

1.4 Changes to the Terms

XQ may amend the Terms at its discretion or where required by new circumstances, for example to comply with new laws or regulatory decisions. By continuing to be a member you accept the amended Terms.

1.5 Contact

Xiqora owns, manages and administers the Xiqora website and the registered trademark Xiqora®. The company can be contacted via the support form on the website.

2. The Service

2.1 Description

Xiqora® is an erotically oriented online community where you, as a registered member, can connect with like-minded adults looking for contact and/or to meet. Members get access to and can search all XQ profiles and images and a range of other services. The member is, of course, 100% anonymous.

Text and images with sexual or otherwise potentially offensive content appear quite frequently.

3. Membership

3.1 Age and identification

Only private individuals aged 18 or older with full legal capacity are allowed to become members and use the Service.

Where there is reasonable suspicion, XQ reserves the right to verify in an appropriate way that the member is 18 or that they are who they claim to be by requesting identity documents or other proof of identity.

3.2 Usernames

The username must not suggest or be confusable with the account holding any kind of official function on Xiqora.

Strongly offensive usernames are likewise prohibited.

3.3 Target audience

Only private individuals with no commercial interests may become members.

3.4 Description

You can use the Service free of charge. However, you must first validate your account at registration via a paid SMS or a card payment of at least 10 SEK or the equivalent in another currency.

This type of membership gives you access to a limited part of the Service, and these features may change or be removed without prior notice. PLUS membership is required for full access, meaning you pay a fee for those features.

3.5 Fees

Current PLUS membership fees are published alongside the order information for that membership type. Standard membership is free and therefore has no fee.

3.6 Account and credentials

At registration you choose an available username and are assigned a random password, which is sent to you by email.

XQ may refuse certain usernames where they infringe a trademark, company name or other intellectual property, are strongly offensive, cause confusion or are otherwise unsuitable for XQ or the member. Login credentials (username and password) are private and confidential and must not be shared with or made available to third parties, either during or after the membership. The member may not transfer, sell or give away their account to anyone other than the person who originally created it. The member undertakes to keep the email address associated with the account current and working to the best of their ability. If the member suspects that their credentials or access to their email account have fallen into the wrong hands, or that an unauthorised person has accessed their account, they must notify XQ as soon as possible so action can be taken.

3.7 Refusal of membership

Xiqora has the right to:

1. refuse a new membership, or terminate an existing one, where we suspect the Terms are not or will not be followed based on experience with prior memberships, blacklisting, or other circumstances brought to XQ's attention.
2. decide, in its sole discretion, who is granted or refused membership.
3. suspend the member from one, several or all services operated by XQ where the Terms are breached or otherwise at its discretion.
4. blacklist, for a short period or until further notice, email addresses, mobile numbers and IP addresses considered harmful to XQ, disruptive to operations, or involved in serious or repeated breaches of the Terms.

3.8 Termination of membership

The member always has the right to close their account whenever they wish, using the dedicated link while signed in to the member area. Xiqora reserves the right to prevent a customer from closing their account during investigations relating to abuse reports or to gather information requested by police, prosecutors or other authorities.

When membership is closed at the member's own request, any paid-in PLUS points received in connection with the purchase of PLUS membership are forfeited. The same applies if the account is closed due to a breach of the Terms. If the member does not use their account for more than twelve months, the account is considered inactive and is closed unless PLUS points remain on it.

4. PLUS membership

4.1 Description

PLUS membership is a paid membership on Xiqora.

1. PLUS members have access to around 30 benefits and extras that Standard members don't.
2. Each night (at midnight), 1 point is deducted from your account balance.
3. An active PLUS membership cannot be paused once it has started.
4. PLUS membership is not deleted due to inactivity.

4.2 Payment methods

The PLUS membership fee can be paid via several methods:

1. card payment
2. paid SMS

Not all payment methods are available in every country; at checkout you'll see which methods are available in your country and how to use them.

4.3 Membership renewal

PLUS membership is not a recurring subscription — it's up to the member to renew their PLUS membership in good time before the points run out, otherwise the membership reverts to Standard.

4.4 Refunds and transfer of points

No refunds of PLUS membership are granted if the member closes their account or if a breach of the Terms leads to suspension/blacklisting. If the member wants to switch to a new account and transfer their points (at least 10 points must remain), they can notify support in good time of the username the points should be transferred to.

5. Member obligations

5.1 Personal responsibility

Use of the Service is at your own risk, and you are responsible for ensuring that the information or material you publish in your profile or in communications with other members complies with applicable law, these Terms and any third-party rights. XQ reserves the right to amend or delete anything that breaches the Terms or could be harmful to XQ, without prior warning, and to claim compensation for any damages or costs incurred.

XQ accepts no responsibility for any damages arising from use of our services — financial, non-financial, legal or psychological.

5.2 Obligations

The member is required to:

1. comply with Swedish law and these Terms as described in this document.
2. provide accurate information as far as possible.
3. respect other members' wishes about who they want to meet or what they're looking for in their profile.

5.3 Prohibited content — profile, journal, ads and messages

XQ performs spot checks and reviews individual profiles and content based on abuse reports from other users; there is no pre-moderation. If anything is incorrect or out of line with the Terms, you'll be notified. For deliberate breaches of the Terms, XQ decides on appropriate action.

XQ is not responsible for individual members' actions or the truthfulness of their statements.

The following must not appear:

1. Seeking contact with persons under the age of 18.
2. Deliberately false, inaccurate, frivolous or misleading information.
3. Public sharing of contact details such as full name, email address, phone number, chat handle, or other personal or confidential information that can identify you or a third party. Exception: in private messages, the member may share their own contact details to continue the conversation outside XQ, for example via email, phone or another channel.
4. Publishing private messages on the member area or elsewhere on the internet.
5. Links to other websites, whether your own or anyone else's.
6. Using the Service for professional, commercial or business purposes — for example to market to customers, attract clients, or buy or sell sexual services or any other non-private purpose.
7. Payment for nude photography. Exception: TFP photography or photography without payment is allowed provided a model release is signed by both parties.
8. Personal attacks, naming or singling out other members without their consent.
9. Racist or xenophobic expressions, agitation against ethnic groups, defamation, harassment, incitement, breaches of confidentiality, conspiracy to commit crimes or other expressions that breach Swedish law.
10. Political or religious messaging.
11. Drug-related messaging.
12. Medicines, drugs, potency products.
13. Seeking persons interested in bestiality, child pornography or incest.
14. Offering or seeking, for payment, striptease, sexual posing, live shows, cam shows, pro-domination, compensated dating, money slaves, sugar daddies, sugar mommies or similar services.
15. Using the Service to spread viruses, trojans, programs, worms or otherwise to gain access to others' computers.
16. Using the Service for mass messaging, spam, chain letters or otherwise affecting the operation of the Service or website abnormally in a way that causes delays or outages.
17. Using the Service to seek or offer jobs, side gigs, premises, housing or similar.
18. Harassment of, or attempts to contact, a member who has explicitly ended contact with you (for example by blocking).
19. Archaic terms for ethnic groups that may be perceived as offensive.
20. Text in languages other than Swedish, Norwegian, Danish or English.

5.4 Prohibited content — images

The following types of images must not be uploaded:

1. Images that breach the Swedish Act on Copyright in Literary and Artistic Works (1960:729).
2. Images advertising competing services or other websites.
3. Images of someone who is, or appears to be, under the age of 18.
4. Images showing someone other than the profile holder(s) clearly identifiable.
5. Images containing contact details such as, but not limited to: phone number, email address, website, MSN, ICQ, Skype, etc.
6. Images showing logos, company names or trademarks.
7. Images showing weapons or similar items.
8. Images containing urine or faeces.
9. Images containing blood, needles or similar items.
10. Images showing uniforms or gear such as those of police, military, firefighters, etc.
11. Images showing cartoon or computer-generated subjects.
12. Images whose main subject consists largely of irrelevant content: landscapes, vehicles, animals, sex toys, lingerie and other material objects, etc.

XQ may, without prior warning, delete images that breach the rules above. Where specific rules don't apply, common sense and individual judgement are used. Repeated breaches result in losing the right to upload new images and/or suspension of your account.

6. Processing of information and personal data

6.1 Personal data and privacy

Xiqora cares about user privacy and applies strict security requirements to prevent unauthorised access or your personal data reaching third parties. When you register, you provide your email address; in connection with PLUS membership orders, your mobile or phone number is stored among other details. Information you provide is private and confidential and is not disclosed to unauthorised parties. XQ logs IP addresses and other technical details related to sign-ins and important events on your account.

Your personal data may be disclosed to authorities where there is suspicion of a crime or where required by Swedish law.

XQ uses the information you provide for the following purposes:

1. To provide support.
2. For quality work, analysis and development.
3. To market the website and its associated services.
4. To publish statistics.
5. To fulfil obligations under Swedish law or regulatory decisions.

XQ reserves the right to publish information from your profile on XQ's main and subdomains where login is not required, to index it in search engines, and to use it in marketing. XQ reserves the right to send communications by email, SMS or similar channels with information or marketing from XQ and its partners.

6.2 Use of cookies

Xiqora uses cookies for the following purposes:

1. To count visitors and give us a sense of how many we have, which helps us dimension and optimise our hardware so your visit is as good as possible. Your visits are of course anonymous — we're not particularly interested in who you are, only how many of you there are. Xiqora uses Google Analytics to collect this data.
2. Our ads should be shown only a few times per visit — not the same ad over and over.
3. Keeping you signed in to the member area so you're signed in automatically if you return within an hour of first signing in.

7. Xiqora's responsibility and warranties

7.1 The Service

To use the Service, each member is responsible for providing suitable hardware and software. The site requires a modern browser with JavaScript and cookies enabled. The site is tested regularly with the most common browsers (Chrome, Firefox, Safari and Edge), but XQ does not warrant that the site is fully functional or free of bugs or other issues.

Each member is responsible for having sufficient knowledge of the hardware and software they use to make use of the Service.

XQ does not guarantee uninterrupted or error-free operation due to causes outside our direct control, or due to maintenance, updates, technical improvements or changes to layout and the like. XQ undertakes, as far as possible, to notify the member of upcoming changes, maintenance work or outages.

7.2 Links

XQ accepts no responsibility for external links to other websites or similar information sources on the internet with regard to availability, content, ads, images, products, services etc.

8. Disputes and governing law

Swedish law applies to these Terms. Disputes regarding the validity, interpretation and application of the Terms, and legal relationships arising therefrom, shall be resolved in the general courts with Stockholm District Court as the first instance.

9. Beta version and limitation of liability

Xiqora is currently provided as a beta version under active development. Features may change, be added or removed without prior notice, and downtime, errors, data loss or bugs may occur.

By creating an account during the beta period you acknowledge that the service is provided "as is" and "as available", without any express or implied warranties. To the maximum extent permitted by applicable mandatory law, Xiqora and its owners disclaim all liability for any direct or indirect damages, lost profits, lost data or other losses arising from use of the service during the beta period.

You remain responsible for the content you publish, your interactions with other members, and for complying with the laws of your country. Feedback and bug reports during the beta are encouraged and may be used by Xiqora to improve the service.
